Caste system is prohibited, but everyone is free to install caste-based display boards as per his wish: Madras HC

The Madras HC held that every person (private) can freely display display boards or other material (irrespective of caste) in his will, as long as they are not obscene or derogatory.

The division bench of Hemalatha was hearing the petition of Amuthan, who sought to instruct the defendant to remove the caste names used in front of educational institutions and shops and other establishments in Tamil Nadu on the basis of representation.

In short, the petitioner raised the complaint regarding the caste names being used in relation to educational institutions, shops and establishments.

The court remarked, “Things under the constitutional scheme to continue the caste system are completely forbidden. However, it is not possible for private individuals to freely display the display board or other material as per their choice freely.unless they are obscene or libelous.”

The Bench observed that the case brought to the notice of the Court is not hearsay and it is not being taken forward and thus the petition was dismissed.
