Calcutta HC Issues Contempt Notice To South Kolkata DCP For Failing To Prevent Obstruction In NHRC Probing Political Violence Allegations

The Hon’ble Calcutta High Court on Friday, framing charges under the Contempt of Courts, Act, 1971 issued a show-cause notice to Deputy Commissioner of Police of South Kolkata, for failing to prevent obstruction to the National Human Rights Commission (hereinafter referred to as “NHRC”) team during their visit to examine post-poll violence allegations in Jadavpur. 

The Hon’ble Court further ordered a re-post-mortems of BJP worker Avijit Sarkar, who was allegedly killed by a mob during the political violence in the State, after considering a supplementary affidavit seeking re-post-mortems of the BJP worker. 

Earlier, the Hon’ble five Judge Bench, condemning State’s attitude on the allegations of political violence, has directed the NHRC to constitute a committee to examine the complaints of post-poll violence in the State. 

Further, the Hon’ble Court also issued notice to the Hon’ble District Magistrate and Superintendent of Police in the violence-affected area. The Order came after the Hon’ble Court finding, in an interim report, that one of the members of NHRC was prevented and obstructed while carrying probe on the allegations of political violence. 

The case is posted for the next hearing on July 13.
