On Tuesday, the Supreme Court had adjourned the hearing of a petition filed by the Centre for Public Interest Litigation (CPIL) to February 9 that was challenging the appointment of Rakesh Asthana to the position of Commissioner of Delhi Police. When the matter was taken, Justice Chandrachud, the presiding judge inquired if the hearing would be over on the same day.
Justice Chandrachud said that he was sitting in collaboration with Justice Sanjiv Khanna and that the present combination may not be there for the coming days. Justice Chandrachud, had also mentioned that the bench will start hearing the matter only under the condition that it can be assured that the hearing will be over on the same day.
The plea had moved through Advocate Prashant Bhushan and added to this was the fact that just 4 days before this retirement, the Ministry of Home Affairs had issued the order of his appointment as Delhi Police Commissioner which thereby extended his service by a period of one year beyond the date of his supposed superannuation.
