The Supreme Court was of the recent observation that the vacancy positions of 62% and 70% of male and female doctors or attendants especially in the District Hospital of Sambhal were an extremely disturbing scenario. This observation was made by the bench of Justices MM Sundresh and SK Kaul who while considering the Special leave petition that was assailing Allahabad High Court’s order which was dated September 9, 2021, in which it was refusing to grant bail to Hazi Mushahid who was accused of murdering two ladies whilst armed.
The bench that judged on January 18, 2022, had directed the State to cross-verify the reasons for the absence of any and all Surgeons in the District Hospital. The Apex Court had also directed the State to file an affidavit that was appropriate for setting forth the position of all Seventy-five District Hospitals in the State with a chart that shows what the existing position of posts occupied is, as against the total number of posts.
Further, noting that the appellant’s role was the same as the other accused, the bench had also remarked that if there was some parity, the appellant would be entitled to bail.
